Kitsumi is free to use. It is not open source.

Kitsumi's own code and assets

No permission is granted to copy, modify, merge, publish, distribute, sublicense, sell, reverse engineer, or create derivative works from any part of Kitsumi, in whole or in part, without prior written permission from the copyright holder. This applies to the source code, and equally to the compiled extension package distributed through the Chrome Web Store, addons.mozilla.org and the Opera add-ons site.

Having access to the source code grants no licence to use, copy, or redistribute any part of it. The fact that a browser extension package is readable once installed or downloaded does not place its contents in the public domain and does not grant any licence to reuse them.

Third-party components

The extension package also contains software and data that is not Kitsumi's, under open licences that grant you rights this licence cannot take away. Section 1 does not apply to those components. Each is governed by its own licence, and those licences prevail over anything here.

Every one of them is listed, with its licence and the path to the full licence text inside the package, in THIRD-PARTY-NOTICES.txt. The same list is readable inside the extension at Settings, About & legal, Third-party licences. In summary:

Dictionaries downloaded through Kitsumi are not part of the package. They are fetched from third-party hosts at the user's request, and each keeps whatever licence its publisher gave it.

Documentation

Documentation in Kitsumi's repositories, meaning the README and other Markdown files, may be quoted for review, commentary and reporting purposes, with attribution.

No warranty

Kitsumi is provided "as is" and "as available", without warranty of any kind, express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. No advice or information obtained through Kitsumi, whether spoken or written, creates any warranty not stated here.

Kitsumi displays material that comes from third-party websites, files and services outside the copyright holder's control. There is no guarantee that any subtitle, dictionary entry, translation, recognised text or generated card is accurate, complete or fit for any purpose, nor that any third-party service will remain available or keep working as it does today.

Limitation of liability

To the maximum extent permitted by applicable law, the copyright holder is not liable for any indirect, incidental, special, consequential or exemplary damages, nor for any loss of or damage to data, loss of profits, or interruption of study or work, arising out of or in connection with Kitsumi or its use, whether the claim is founded in contract, tort or otherwise, and even if the possibility of such damage was known.

Where liability cannot lawfully be excluded, it is limited to the amount you paid for Kitsumi, which is nothing.

Nothing in this licence excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that applicable law does not allow to be excluded or limited. If you are a consumer, this licence does not affect your statutory rights.

Use of the software

Kitsumi is a tool. It hosts no video, no subtitles and no dictionaries, and it supplies no copyrighted content of its own. What it shows you comes from the page you are on, from files you provide, or from third-party services you choose to enable.

You are responsible for having the right to access that material, and for complying with the terms of the sites and services you use Kitsumi with.

Governing law

This licence, and any dispute arising out of it or out of the use of Kitsumi, is governed by the laws of Ukraine, without regard to its conflict-of-law rules, and the courts of Ukraine have jurisdiction over any such dispute.

If you are a consumer, the mandatory consumer-protection law of the country where you live still applies to you, and you may also bring a claim in the courts of that country; nothing here takes that away.

If any part of this licence is found unenforceable, the rest of it stays in force.
